هل الاتفاق الشفهي ملزم قانونياً؟

لكن المشكلة الأساسية في الاتفاق الشفهي ليست في صحته القانونية، بل في إثباته أمام القضاء. فعند حدوث نزاع بين الأطراف، يصبح من الصعب إثبات وجود الاتفاق أو تحديد شروطه بدقة، خاصة في غياب شهود أو أدلة داعمة.
لهذا السبب، يوصي المختصون قانونياً دائماً بتوثيق أي اتفاق مهم كتابةً، حتى وإن كان بين أشخاص تجمعهم علاقة ثقة. فالعقد المكتوب يحدد الحقوق والالتزامات بوضوح، ويجنب الأطراف كثيراً من النزاعات المستقبلية.
الخلاصة:
الاتفاق الشفهي قد يكون صحيحاً من الناحية القانونية، لكنه يبقى ضعيفاً من ناحية الإثبات. لذلك يبقى التوثيق الكتابي هو الخيار الأكثر أماناً لحماية الحقوق.
