الطلاق للضرر أم الخلع؟ – أي الخيارين أفضل للزوجة؟
في الحياة الزوجية، قد تمر بعض الزوجات بظروف صعبة مثل الامتناع عن النفقة أو الهجر، مما يجعل استمرار العلاقة الزوجية مستحيلًا. هنا يظهر سؤال شائع لدى الكثير من النساء: هل أطلب الطلاق للضرر أم أطلب الخلع؟
أولًا: الطلاق للضرر
الطلاق للضرر هو دعوى ترفعها الزوجة إذا تعرضت لضرر نفسي أو مادي نتيجة تصرفات الزوج، مثل:
• امتناعه عن النفقة
• هجرها لفترة طويلة دون مبرر
• الإساءة اللفظية أو الجسدية
مميزات هذا الخيار:

✔️ تحصل على مؤخر الصداق والنفقة والمتعة (إن وُجدت)
✔️ تثبت الضرر وتكسب حكمًا قضائيًا لمصلحتها
الشرط الأساسي: إثبات الضرر أمام المحكمة
ثانيًا: الخلع
الخلع هو دعوى تطلب فيها الزوجة الطلاق من زوجها دون الحاجة لإثبات الضرر، لكنها تُقدِّم تنازلًا ماليًا، مثل:
• رد المهر
• التنازل عن مؤخر الصداق أو النفقة
متى تلجأ الزوجة للخلع؟
إذا كانت لا تستطيع الاستمرار في العلاقة، حتى دون وجود ضرر ظاهر أو غير قادرة على إثباته، وتُفضل الانفصال بسرعة.
ما الخيار الأفضل؟
• إذا كان الضرر واضحًا ويمكن إثباته (مثل النفقة أو الهجر)، فالطلاق للضرر هو الأنسب مع الحفاظ على الحقوق.
• إذا كانت الزوجة تفضّل إنهاء العلاقة بسرعة دون الدخول في نزاع أو إثبات ضرر، فالخلع هو الطريق الأسرع، لكن مع تنازل مالي.
