تُعد جريمة النصب والاحتيال من الجرائم الاقتصادية التي تشهد تزايدًا في المجتمع الكويتي، خاصة مع انتشار المعاملات الإلكترونية والتسويق عبر الإنترنت. وهي جريمة تستهدف أموال الآخرين عن طريق الخداع والتلاعب، مما يستوجب وعيًا قانونيًا واتخاذ إجراءات فورية عند التعرض لها.
ما هي جريمة النصب؟
هي كل عملية استيلاء على مال الغير باستخدام وسائل احتيالية مثل الكذب أو تقديم بيانات وهمية أو وعود زائفة، تؤدي إلى وقوع الضحية في فخ الخداع وتسليم ماله عن طواعية.
أركان الجريمة:
1. الركن المادي: استخدام طرق احتيالية مثل التمثيل الكاذب، وثائق مزورة، أو وعود بأرباح وهمية.
2. الركن المعنوي: نية الجاني المسبقة في الخداع والاستيلاء على أموال الضحية.
3. تسليم المال: الضحية يسلم المال بناءً على ثقة بنيت على الكذب والخداع.
هل النصب جناية أم جنحة؟
بحسب القانون الكويتي، النصب والاحتيال يُعد جنحة في حال كانت المبالغ بسيطة أو الوسائل غير مشددة، وتصل العقوبة إلى 3 سنوات حبس أو غرامة مالية أو كليهما.
وفي حالات مشددة (مثل التكرار أو وجود عصابة أو تزوير مستندات)، قد تُرفع إلى جناية تصل عقوبتها إلى 5 سنوات سجن وغرامة كبيرة.
متى تحتاج إلى محامي؟
• إذا كنت ضحية نصب وتحتاج إلى رفع دعوى واسترداد أموالك
• إذا وُجهت إليك تهمة احتيال وتريد الدفاع القانوني
• إذا احتجت إلى استشارة قبل توقيع عقد أو الدخول في استثمار
