قضايا الطلاق في الكويت – الإجراءات والحقوق القانونية
يُعد الطلاق من القضايا المهمة التي تنظمها الشريعة الإسلامية وقانون الأحوال الشخصية الكويتي، حيث يتم التعامل مع كل حالة وفقًا للأدلة القانونية والشرعية التي تضمن حماية حقوق الزوجين والأبناء. تختلف إجراءات الطلاق والحقوق المترتبة عليه حسب نوع الطلاق والظروف المحيطة به.
أنواع الطلاق في الكويت
🔹 الطلاق الرجعي:
• يحق للزوج مراجعة زوجته خلال فترة العدة دون الحاجة إلى عقد جديد.
• لا يتطلب موافقة الزوجة، لكنه يخضع للضوابط الشرعية.
🔹 الطلاق البائن بينونة صغرى:
• لا يمكن للزوج إعادة الزوجة إلا بعقد ومهر جديدين.
• يتم بعد انتهاء العدة دون مراجعة الزوجة.
🔹 الطلاق البائن بينونة كبرى:
• لا تحل الزوجة للزوج إلا بعد زواجها من رجل آخر زواجًا صحيحًا ثم طلاقها منه.
• يُعتبر من أشد أنواع الطلاق ولا رجعة فيه إلا بشروط شرعية.
🔹 الخلع:
• طلب الطلاق يكون من الزوجة مقابل تنازلها عن بعض الحقوق المالية (مثل المهر والمؤخر).
• يتم إذا رأت الزوجة استحالة استمرار الحياة الزوجية.
🔹 الطلاق القضائي:
• يتم بحكم المحكمة بناءً على ضرر وقع على الزوجة مثل الإيذاء أو عدم الإنفاق.
• يحتاج إلى إثبات قانوني ويخضع لتقدير القاضي.
إجراءات الطلاق في الكويت
1️⃣ تقديم طلب الطلاق لدى محكمة الأحوال الشخصية.
2️⃣ إحالة القضية إلى لجنة الإصلاح الأسري لمحاولة الصلح بين الزوجين.
3️⃣ في حال فشل الصلح، يتم تحويل القضية إلى القاضي للنظر في الأسباب والأدلة.
4️⃣ إصدار الحكم بالطلاق وتحديد الحقوق (مثل النفقة والحضانة).
5️⃣ توثيق الطلاق رسميًا في وزارة العدل الكويتية لضمان الاعتراف به قانونيًا.
حقوق الزوجة والأبناء بعد الطلاق
✔ النفقة الشرعية: تشمل المأكل والمسكن والملبس خلال فترة العدة، كما تشمل نفقة الأطفال.
✔ حضانة الأطفال: غالبًا ما تمنح للأم وفقًا لعمر الطفل ومصلحته.
✔ مؤخر الصداق: يحق للزوجة المطالبة به إذا لم يكن مدفوعًا مسبقًا.
✔ مسكن الحضانة: تلتزم المحكمة بتوفير سكن مناسب للأم الحاضنة.
✔ حق الزيارة: يحق للوالد غير الحاضن رؤية أطفاله وفقًا لتنظيم المحكمة.
